Effective date: 10 August 2025 · Pathhog Creator Terms v1.2
These Creator Terms ("Terms") govern your use of Pathhog's services that create and operate your Pathhog page (the "Pathboard"). By accepting these Terms and completing verification, you agree to be bound by them and you represent that you are at least 18 years old (or the age of legal majority in your country).
Your use of the Pathboard and processing of your data are also governed by the Pathhog Privacy Policy (Effective 10 August 2025).
1. DEFINITIONS
- Affiliate Revenue: Net amounts Pathhog actually receives from affiliate partners (e.g., Klook, GetYourGuide, Viator, Trip.com, Expedia) for transactions attributed to Pathhog traffic, after refunds, cancellations, chargebacks, partner deductions/fees, taxes, payment processing/FX fees.
- Creator Pool: The percentage of Affiliate Revenue allocated to creators for a given calendar month. Current default: 70% (Pathhog retains the balance).
- Unique Click: A distinct outbound click to a monetized link from a Pathboard session, deduplicated using reasonable anti-fraud measures and excluding invalid traffic.
- Attributable Clicks: Unique Clicks assigned to your Pathboard under Pathhog's attribution rules for the relevant month.
- Creator Instagram Content: Your publicly available Instagram profile fields (name, handle, bio, profile links), public posts/reels/videos, captions, timestamps, public like/comment counts, public location tags and hashtags, and promo codes in your bio.
- Effective Date: The date you accept these Terms.
2. SCOPE AND PURPOSE
Pathhog operates tools that help you present and monetize your publicly available Instagram content via a Pathboard for your followers' discovery and bookings. These Terms set out what we collect, how we process it (including LLM summarization), monetization, payments, and your/our rights and obligations.
3. WHAT WE COLLECT (PUBLIC INSTAGRAM ONLY)
3.1 Public IG content only. Pathhog collects publicly available Creator Instagram Content that you own and control. We do not access private or login-protected content and we do not circumvent Instagram technical controls.
3.2 No sensitive data. Please do not include personal data of others or confidential information in your Instagram content intended for Pathboard display.
4. HOW WE USE LLMS
We use automated systems, including large-language models, to transform public Instagram text into structured entries for your Pathboard. Specifically, we:
- read captions to extract place names, categories (e.g., cafe, trail, theme park) and short tips for navigation;
- read your profile bio to produce a short, crystallized bio suitable for display (we remove emails/irrelevancies);
- detect promo codes present in your bio and display them in a clearer UI.
We do not sell your raw creator data.
5. CONSENT, VERIFICATION AND USE RIGHTS
5.1 Affirmative consent. You must affirmatively accept these Terms and our Privacy Policy (checkbox + "I agree") before validation.
5.2 Account validation. After accepting, you will paste a short verification code into your Instagram bio. Our system checks for the code to confirm you control the account. Removing the code later does not revoke your agreement — you must use the in-app revocation control.
5.3 Licence to use content. You grant Pathhog a non-exclusive, worldwide, royalty-free licence to use, cache, display, index, transform (including LLM summarization), and link to Creator Instagram Content solely to operate and promote your Pathboard and Pathhog's services. You retain ownership of your content; Pathhog retains all rights in the Pathhog platform, aggregated insights and tooling.
5.4 Your representations. You represent and warrant that you have rights to the content you post and that our use under these Terms will not infringe third-party rights.
6. CONSENT RECORDS (APPEND-ONLY)
We keep tamper-evident, append-only logs of consent and validation events: creator UID, timestamp (UTC), IP/country, user agent, Terms/Privacy version hash, and server-side verification metadata. We retain these records as long as reasonably necessary for legal, compliance, and audit purposes.
7. REVOCATION AND DISPLAY STOP
7.1 Revocation. You may revoke permission at any time in Settings.
7.2 Display stop (24h). If you revoke, Pathhog will stop displaying and refreshing your Instagram content on your Pathboard within 24 hours.
7.3 Caching beyond Pathhog's control. Pages already cached on user devices, third-party caches or preloaded views may persist temporarily and are outside our control.
8. DATA RETENTION AND DELETION
8.1 Operational retention. We retain Creator Instagram Content while your Pathboard is active and for up to 30 days after revocation or account closure solely to complete reporting/payouts and comply with legal/accounting obligations, after which we delete or de-identify it. Any remaining backups are isolated from live systems and used only for the purposes in this section.
8.2 Personal data you provide. Personal/identifiable data you provide to us (e.g., payout details, email) will be deleted or de-identified within 30 days after revocation or account closure, except where retention is required for taxes, legal compliance, fraud prevention or claims handling.
8.3 Derived/aggregated analytics. Non-identifying analytics (e.g., de-identified click counts, category labels, non-identifying model outputs) may be retained to improve the services.
9. PROMO CODES
If promo codes appear in your bio or you provide them to us, you authorise Pathhog to display them. Revenue paid directly to you via your own codes is yours and is not part of Affiliate Revenue. Pathhog is not responsible for code validity or merchant fulfilment.
10. REVENUE SHARING AND PAYMENTS
10.1 Creator Pool (currently 70%). For each month, Pathhog aggregates Affiliate Revenue actually received from partners and allocates a Creator Pool equal to seventy percent (70%) of that revenue.
10.2 Your monthly payout formula. Your payout = Creator Pool x (Your Attributable Clicks / Total Attributable Clicks across all creators for that month).
10.3 Attribution details. We use Unique Clicks (deduped and filtered for invalid traffic). Where affiliate partners provide transaction-level attribution that is more accurate than click share, we may use it partially or fully for allocation and adjustments.
10.4 Adjustments. We may adjust for refunds, chargebacks, suspected fraud/invalid activity, partner clawbacks or reporting corrections. If adjustments reduce prior reported earnings, future statements may be offset.
10.5 Reporting & schedule. Monthly statements will show the Creator Pool, your Attributable Clicks, total network clicks, and your computed share. Payouts are made within 30 days after month end.
10.6 Minimum payout. Minimum payout threshold is SGD 50 (unpaid balances roll over). Processor or FX fees may be deducted from your payout. You must maintain a valid payout method.
10.7 Taxes. You are responsible for your taxes. We may withhold amounts required by law.
10.8 Final payouts on revocation. Earnings accrued up to the effective revocation date will be paid to your last known payout method. If missing or failing, we will notify you and hold funds for 180 days pending valid payout details and any required verification. Unclaimed funds after that period are forfeited.
10.9 Audit (lightweight). On written request (not more than once per 12 months), we will review our calculation methodology for the prior three (3) months. Reviews occur under confidentiality and at your cost unless an error of ≥5% in your favour is found.
11. FRAUD AND INVALID ACTIVITY
You agree not to generate artificial traffic (e.g., bots, incentivized/automated clicks, self-clicking, manipulation). Pathhog may withhold or claw back payouts, suspend monetization or accounts, and exclude traffic we reasonably deem invalid.
12. PLATFORM CHANGES AND AVAILABILITY
Affiliate programs, rates, tracking methods and partners may change or be discontinued by third parties. We do not guarantee continuous availability of any partner, program or tracking method.
13. CHANGES TO CREATOR POOL % AND TO THESE TERMS
We may modify these Terms (including the Creator Pool percentage) with at least 30 days' prior notice via dashboard notice and/or email. Changes apply prospectively from the stated effective date. If you do not agree, you may revoke/terminate before that date; continued use after the effective date constitutes acceptance. Shorter notice may apply where required for legal or security reasons.
14. INTELLECTUAL PROPERTY
Except for the licence in Section 5.3, all rights in and to Pathhog's services, software, UI, databases and aggregated/de-identified insights are owned by Pathhog and its licensors.
15. THIRD-PARTY SERVICES AND LINKS
Your use of third-party sites and services (e.g., Instagram, affiliate partners) is subject to their terms and policies. Pathhog is not responsible for third-party actions, failures or content.
16. DISCLAIMERS
The services are provided "as is" and "as available." To the maximum extent permitted by law, Pathhog disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that services will be uninterrupted, accurate or error-free.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Pathhog's aggregate liability arising from or relating to these Terms will not exceed the amounts paid to you by Pathhog in the six (6) months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues or data.
18. INDEMNITY
You will indemnify and hold harmless Pathhog and its affiliates from claims arising out of your content, your breach of these Terms, or your violation of laws or third-party rights.
19. TERM, SUSPENSION AND TERMINATION
We may suspend or terminate access for breach, fraud/invalid activity, legal risk, or repeated violations. You may terminate at any time via Settings. Sections that by nature should survive (including payment obligations, IP, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) will survive termination.
20. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction, unless applicable law requires otherwise.
21. FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control.
22. ASSIGNMENT
You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets.
23. NOTICES
We may provide notices via email, dashboard, in-product messages, or by posting updated terms. You are responsible for keeping your contact information current.
24. ENTIRE AGREEMENT; SEVERABILITY; NO WAIVER
These Terms constitute the entire agreement regarding the Pathboard and supersede prior understandings. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver.
